For many trafficking survivors, filing a T-visa application is only the beginning of a long and uncertain wait, one that can stretch on for years with no income and no formal protection in the meantime. A policy change that took effect in 2024 created a faster checkpoint in that process, one that is giving many applicants real protection long before their case is fully decided.
At Francis Law Center, our attorneys help survivors understand exactly where their T-visa case stands and what protections are available to them at every stage, not just at final approval. We explain what a bona fide determination is, how long it currently takes, and what it does and does not mean for your case.
What a Bona Fide Determination Actually Is
A bona fide determination is not your T-visa approval. It is an earlier checkpoint where USCIS reviews Form I-914 to confirm the application is complete, properly filed, and supported by credible evidence. If the case clears that review, USCIS can grant deferred action and eligibility for a work permit while the full application continues moving through the system.
This checkpoint exists because of a final rule that took effect in 2024, created specifically to address the growing gap between filing a T-visa case and receiving a final decision on it.
Why It Matters So Much Right Now
USCIS currently takes roughly 33 months, nearly three years, just to reach a bona fide determination after a case is filed. The final decision on Form I-914 comes later, and USCIS does not publish a separate timeframe for that stage. Before the 2024 rule, survivors had no formal path to work authorization or protection from removal during this entire stretch.
A bona fide determination now gives eligible applicants several protections that matter immediately.
- Deferred action, which pauses removal proceedings while the case remains pending
- Eligibility for an Employment Authorization Document, allowing lawful work in the United States while the case continues
- A documented, pending status that can support related requests, such as a stay of removal
- Peace of mind that comes from having formal recognition of the case while the full application is still under review
Neither benefit is permanent, and neither guarantees the T-visa will ultimately be approved. For someone rebuilding a life after trafficking, though, months or years of legal work authorization and protection from deportation can make an enormous difference.
How to Strengthen Your Position Early
Filing Form I-765 for work authorization alongside Form I-914, rather than waiting to submit it later, allows USCIS to issue an employment authorization document as soon as the case qualifies. A complete, well-documented I-914 package also reduces the risk of a Request for Evidence, which can add months to either stage of review.
Applicants relying on the trauma exception rather than law enforcement cooperation should include thorough medical or mental health documentation, since vague or incomplete claims are a common reason cases stall.
What a Bona Fide Determination Does Not Do
A bona fide determination does not start the clock toward a green card. That three-year countdown only begins once an applicant receives final T-1 approval, not when deferred action or work authorization is granted.
It also does not guarantee the underlying case will be approved, since the full I-914 application still has to clear a complete USCIS review before lawful T-1 status is granted. It is not permanent either, since deferred action and work authorization can be revoked if circumstances change or new information affects the case.
And it does not remove the other requirements applicants must still meet down the line, including continuous presence, ongoing cooperation with law enforcement where applicable, and good moral character before final approval.
