Breaking News: Texas Court Strikes Down Keeping Families Together Parole in Place Program – What Families Can Do Next

Texas Court Strikes Down Keeping Families Together Parole in Place Program – What Families Can Do Next

On November 7, 2024, a Texas federal court struck down the Keeping Families Together Parole in Place (PIP) Program, which has provided relief to undocumented family members of U.S. citizens or residents. This program was crucial in helping families stay together without the risk of deportation and leaving the United States while they pursued legal status. Although the Department of Homeland Security (DHS) may appeal the decision, there’s a strong chance that President Trump would eliminate the program altogether. This leaves many families facing uncertainty, but there are alternative options available to help.

At Francis Law Center, we understand how important it is for families to remain together. If you or a loved one relied on the Keeping Families Together PIP Program, here are the top five alternative immigration options to consider:

1. DACA Advance Parole

For those with Deferred Action for Childhood Arrivals (DACA) status, Advance Parole is a legal means to leave and re-enter the U.S. without jeopardizing your status. This option is primarily available for DACA recipients who need to travel for humanitarian, employment, or educational purposes. Returning to the U.S. with Advance Parole could be an important step toward adjusting to lawful permanent residency later. For families affected by the loss of the PIP program, DACA recipients should explore whether Advance Parole could offer needed flexibility.

2. U Visa

The U Visa provides temporary legal status and work authorization to victims of specific crimes who have cooperated with law enforcement in investigations or prosecutions. This option is meant to support individuals who have suffered substantial mental or physical abuse due to a qualifying crime, including domestic violence, trafficking, or other serious offenses. If you or a family member has been a victim of a crime and reported it, the U Visa may be a potential pathway to legal status and, eventually, a green card.

3. T Visa

The T Visa is available to individuals who are victims of severe forms of human trafficking, including labor and sex trafficking. This visa provides protection for trafficking survivors and grants them work authorization while they collaborate with law enforcement. In addition, it may offer a path to a green card for both the applicant and certain qualifying family members. If the Keeping Families Together PIP Program no longer provides relief, families affected by trafficking should look into the T Visa as a viable alternative.

4. Military Parole in Place

The Military Parole in Place program remains an option for certain family members of U.S. military personnel and veterans. If your spouse, child, or parent is serving in the military or is a veteran, you may be eligible for this program, which allows undocumented family members to stay in the U.S. temporarily without the fear of deportation. This program provides peace of mind to military families who need stability at home, allowing them to focus on their service.

5. 601A Waiver

The 601A waiver is an excellent option for those whose only immigration violation is unlawful presence. This waiver allows eligible individuals to request forgiveness for unlawful presence before leaving the U.S. for consular processing. The 601A waiver can significantly reduce the time spent outside the U.S. and minimize family separation, making it an effective alternative for those affected by the PIP Program decision. With this waiver, families can complete the final steps of their immigration process without prolonged separation.
