How to obtain the K-1 visa in Illinois

On Behalf of | Feb 25, 2022 | Family Immigration, K1 Fiance Visa |

If you are looking to bring your foreign fiancé to the United States, you will need to apply for a K-1 visa. This type of visa is for people who want to get married in the United States. In order to be eligible, you must meet several requirements. You also need to follow a specific application process to obtain it.

What are the requirements?

The K-1 visa can allow your fiancé to live in the United States temporarily while they wait for their green card. In order to qualify for a K-type visa, you and your fiancé must meet several requirements. First, you must have met each other in person within the last two years. Second, you must be able to show that you are both capable of getting married. This means that you must provide proof that you are both single and that you have the financial resources to support yourselves. Furthermore, your fiancé must not have any immigration violations.

What is the application process?

In order to apply for a K-type visa, you will need to complete a few steps. First, you will need to file a petition with the USCIS. You can do this by filling out Form I-129F and submitting it along with all of the required supporting documents. After your petition gets approved, your fiancé will need to apply for their visa at the nearest U.S. embassy or consulate.

They will need to complete Form DS-160, pay the visa application fee and provide a passport-style photograph. After their visa is approved, they may be able to come to the United States and get married. If your partner has children below the age of 21, they may come to the United States as well if they’re included in the Form I-129F petition.

Remember that if your fiancé enters the United States on a K-type visa, the authorities will allow them to stay for up to 90 days. During this time, you must get married and file a Form I-485 to apply for their green card. If you do not get married within 90 days, your fiancé will have to leave the country.
