Having a Permanent Resident Card, also known as a Green Card, has many benefits. With a Green Card, you can live and work in the United States for as much time as you want. If you plan to create a new commercial enterprise in the U.S., or have already done so, you may qualify as an immigrant investor and obtain your Green Card.
EB-5 immigrant investor visa
The immigration law in the United States allows foreigners to obtain permanent residence if they invest in a new company that will benefit the country’s economy. To get a Green Card, a person must invest at least $1,800,000 and create 10 full-time jobs for Americans within two years after the investment. However, the investment amount required for an investor visa is less if the person establishes a company in a high-unemployment area, in which case they would need to invest at least $900,000.
How to apply
If you meet the government’s requirements, you, your spouse and your kids can get an immigrant visa. To get your EB-5 investor visa, you will need to file the following forms and applications:
· Form I-526, Immigrant Petition by Alien Investor
· Form DS-260, Application for Immigrant Visa and Alien Registration
· Form I-485, Application to Register Permanent Residence or Adjust Status
· Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status
You will need to file for these forms in that order. After the U.S. Citizenship and Immigration Services approves your petition to remove the conditions on your permanent resident status, you will get your Green Card.
Interview and medical examination
Apart from all the documents you will need to submit with the forms, you must also attend a visa interview and submit a medical examination. An authorized physician must perform the medical examination, and to pass it, you will need to have all required vaccinations. Your spouse and children must also complete the medical examination.
Getting your Green Card
The time it takes for a person to complete the process for an investor visa varies. Sometimes, the process can be delayed if you don’t follow the instructions of the forms carefully. That is why it would be in your best interest to seek help from an experienced attorney when filing for your visa. That way, you’ll get assurance that you’ll get your Green Card as soon as possible.
